BIG DAISHOWA Switzerland AG (BDCH) is committed to continuously improving the service and information offering for its customers and business partners, thereby contributing to mutual business success. In an era of increasing globalisation, personal data are regularly used and processed by BIG DAISHOWA in connection with our business relationships.
BIG DAISHOWA takes the protection of your personal data very seriously and complies with all applicable data protection legislation. We have therefore prepared the following information to give you a clear overview of how BIG DAISHOWA processes your personal data and of your rights as a data subject. We kindly ask you to share this notice with any employees who are in business contact with us.


Your personal data

This privacy notice applies to all personal data that you, as a natural person and business partner (e.g. as a consumer, entrepreneur, or employee of one of our business partners), provide to us in the context of our business relationship with you and/or your company.


Controller

BIG DAISHOWA Switzerland AG, Glattalstrasse 516, CH-8153 Rümlang, Switzerland, or the respective BIG DAISHOWA affiliated company (hereinafter also "we" or "us"), acts as the controller within the meaning of the EU General Data Protection Regulation (GDPR) and the Swiss Federal Act on Data Protection (FADP; German: DSG), and determines the purposes and means of processing your personal data in accordance with this notice.


Personal data we process

We process personal data received from you in the course of our business relationship — whether arising from a contractual relationship with you and/or your company (such as the purchase and sale of products, services, work, or rights of use), a pre-contractual enquiry initiated by you, or another request on your part (e.g. via the internet, email, telephone, or at a trade fair or product event).

Where necessary to fulfil our contractual or legal obligations, we also process personal data lawfully obtained from publicly accessible sources (e.g. commercial registers, press, internet) or legitimately provided to us by third parties (e.g. in the context of a credit check).

Relevant personal data include in particular: identification details (e.g. surname, first name, address, bank details, VAT/tax identification number) and contact data (e.g. telephone number, email address). This may also include order data, data arising from the performance of contractual obligations, financial information, documentation data, and other comparable data.

As a rule, we use and store the following categories of personal data: first name, last name, postal address, email address, telephone number, mobile number, fax number, salutation, occupation, position, title, and academic degree.


Purposes of processing

We process your personal data primarily to perform contracts with you and/or your company, or to carry out pre-contractual measures at your request. You must provide the personal data required to establish, manage, and conclude the business relationship and fulfil the associated contractual obligations. Without this data, we will generally be unable to enter into or perform a contract with you.

Your data also helps us understand your interest in our products, develop our business relationship, and, where requested, provide you with marketing information. Personal data are stored in our group-wide database for the processing purposes described in this notice.


Legal basis for processing

We process personal data in accordance with the GDPR and the FADP, in particular on the following legal grounds:

  1. Performance of contractual obligations (Art. 6(1)(b) GDPR): processing is necessary for the performance of a contract with you or to carry out pre-contractual measures.
  2. Compliance with legal obligations (Art. 6(1)(c) GDPR) or public interest (Art. 6(1)(e) GDPR): e.g. tax reporting and control obligations, regulatory audits, and statutory retention periods.
  3. Legitimate interests (Art. 6(1)(f) GDPR): where necessary, we process your data on the basis of a balancing of interests, in particular for:
  1. asserting legal claims and defence in legal disputes;
  2. maintaining supplier and CRM databases;
  3. promoting products and campaigns;
  4. nsuring operational security and business management;
  5. building and facility security measures;
  6. screening against embargo and sanctions lists;
  7. reducing default risks through creditworthiness checks;
  8. restricted data retention where deletion is not feasible.


Recipients of your personal data

Within BIG DAISHOWA, only those departments that require your data to fulfil our contractual and legal obligations have access to it. Service providers and processors engaged by us may also receive and process data for these purposes (e.g. legal and business consultants, IT service providers, banks, and logistics companies).

We only disclose personal data to third parties where required or permitted by law, or with your explicit consent. Recipients may include:

  • public authorities and institutions (e.g. tax authorities, law enforcement, social security bodies);
  • insolvency administrators or creditors in enforcement proceedings;
  • auditors in connection with annual financial statement audits;
  • service providers acting as data processors on our behalf.


Where your personal data are processed

As part of a global group, your data may be processed outside Switzerland or the European Economic Area (EEA), including in countries with data protection standards that differ from those of the EEA. In all such cases, we ensure an adequate level of protection, in particular by entering into the European Commission's Standard Contractual Clauses pursuant to Art. 46(2)(c) GDPR (available at eur-lex.europa.eu).

Retention periods

We retain personal data for as long as necessary to fulfil our contractual and legal obligations. Data no longer required for these purposes will be deleted regularly, unless further retention is required by commercial or tax law, or to preserve evidence within applicable limitation periods.
Where you have consented to the use of your data for marketing purposes, we will retain the relevant data until you object or withdraw your consent.

 

Your rights as a data subject

To exercise the rights listed below, or for any questions regarding the use of your personal data, please contact us at privacy@bigdaishowa.eu. You have the right to:

  • rectification or updating of your personal data;
  • receive a copy of your personal data held by us;
  • erasure of your personal data where there is no longer a legal basis for processing;
  • data portability to another controller;
  • restriction of processing;
  • object to the processing of your personal data.

We reserve the right to invoke statutory limitations on the above rights in order to safeguard the public interest or our legitimate business interests. If you are not satisfied with our response, you may contact the Swiss Federal Data Protection and Information Commissioner (FDPIC) under Art. 28 FADP, or, within the EU, the competent supervisory authority under Art. 77 GDPR.


Receiving information by email

With your consent, we would like to use your name and email address to inform you about BIG DAISHOWA products and, where requested, send you other product, company, event, or marketing information. You can manage your preferences at bigdaishowa.eu and withdraw your consent at any time by emailing privacy@bigdaishowa.eu.
